Client hired the DUI Defense Team after trying to navigate through the Kansas Department of Revenue’s Driver Control bureaucracy. After a stop on suspicion of DUI, a law enforcement officer arrested Client for DUI and demanded that she submit to a breath test. Client attempted twice to give a breath sample for testing, but, due to her asthma, she could not give an adequate sample. The cop did not believe her and reported that she refused to provide a breath test. Client requested the administrative hearing without the assistance of the DUI Defense Team, and the hearing officer refused to consider the evidence she tried to offer. Then Client hired Jess Hoeme.
The DUI Defense Team’s Jess Hoeme filed a petition for review with the district court. Upon receipt of the petition, the Department of Revenue determined that the hearing officer was wrong. Client’s driving privileges were reinstated, and her record was cleared.
