What is an uncontested divorce?
An uncontested divorce is a divorce in which parties agree on their own as to how to handle the division of property, child custody and support, spousal support, and any other matters they may wish to consider. Parties must agree on all matters for the divorce to be uncontested. If the parties disagree on even one issue, the divorce is considered contested and must go before a court.
After an agreement has been made on all issues, the court may then decide to grant the divorce without the need to go through significant litigation. However, it is not required to grant the divorce on the terms proposed by the parties. If the court determines that one or more of the terms of the divorce are inequitable, or unfair, it may require the parties to renegotiate. Uncontested divorces tend to be less expensive and less time consuming than contested divorces.
How long does a divorce case take?
Depending on the case, divorces can take anywhere from one month to several years. Uncontested divorces tend to go much quicker than contested. Parties with several major disagreements may find themselves in court more often and for a longer period of time. Even after a divorce is finalized, parties may still return to court for matters of child support and/or custody.
In Kansas, courts generally require a minimum waiting period of 60 days between the filing of a divorce petition and the divorce decree. In Missouri, courts require a 30-day waiting period. These waiting periods apply in both contested and uncontested divorces, and are meant to prevent parties from acting impulsively.
