The Topeka Capital-Journal reported attorney Chris Joseph wants charges against his client dismissed. In a brief submitted to Shawnee District Court Judge Cheryl Rios, Joseph explains that the unlawful sexual relations statute is written to forbid consensual conduct. Because former students say the advances by his client were unwanted, Joseph says the felony charges do not fit. Though he would not be pleased with a dismissal, Kansas Rep. John Carmichael (Wichita) said, “the attempt by Chris Joseph, the attorney representing Co, to have the case dismissed is ‘probably good lawyering.’” A hearing next month will determine whether the case goes to trial on the pending felony charges.
