Aggravated DUI: Kansas Lawmakers Look to Toughen DUI Penalties

The Kansas Legislature recently passed a bill that broadens prosecutors’ charging options when DUI results in an injury accident.  The bill, known as the “Aggravated DUI Bill,” passed unanimously in the House and the Senate, and it is on its way to the Governor to be signed into law.

The “Aggravated DUI Bill” allows prosecutors to charge aggravated battery in addition to DUI when the circumstances of the case involve an injury accident. In the past, evidence of reckless behavior beyond intoxication was required to file battery charges when DUI resulted in an injury accident. The “Aggravated DUI Bill” eliminates this requirement. The increased availability of the combined charge substantially augments potential penalties.
