Title VII of the Civil Rights Act of 1964 prohibits employment discrimination “because of … sex.” This week, the United States Supreme Court heard oral argument on whether Title VII protects gay, lesbian, and transgender employees. Only 21 states specifically bar discrimination on the basis of sexual orientation or gender identity. Kansas is not among them. Thus, the court’s ruling could have particular significance here.
